Protection of intellectual property rights and personal data of the non-profit company Istorima

The use by any on-line visitor/user of the contents of the Archive, the owner, creator, and beneficiary of which is the non-profit company Istorima, presupposes complete and unreserved acceptance of the following terms, which cover the whole of the contents of the Archive: interviews (audio, video, transcripts), metadata, files, documents, graphics, text, video, images and other similar elements and marks that are included in the Archive.

The on-line visitor/user should read the terms of use carefully and, if they do not agree, they must not use the contents of the Archive. Acceptance of them ensures the right of access to and use of the contents of Istorima’s archive.

Protection of intellectual property rights

The whole of the contents of Istorima’s archive, which indicatively includes interviews (audio, video, transcripts), metadata, files, documents, graphics, text, video, images and other similar elements and marks, is the intellectual property of the non-profit company Istorima on the basis of national and international law in force on intellectual property rights, which provides for, where third parties are involved, permission to use. More specifically, photographs, images, and similar elements are provided to the non-profit company Istorima by third parties only in cases where these are within their ownership and possession.

Logotypes, names, labels, and distinctive features that are included in the contents of the Archive belong to the non-profit company Istorima and are protected under national legislation in force regarding industrial and intellectual property.

Permission to use the contents of Istorima’s archive

The non-profit company Istorima permits the personal use of the contents of the Archive informational without permission for, educational, research, academic, entertainment and similar reasons, which includes its use by associations, foundations, and non-profit organisations. Use of the contents by enterprises or for-profit organisations with the aim of their direct or indirect commercial exploitation does not constitute personal use but commercial use. It is a pre-condition of the above-mentioned commercial use that the intellectual and industrial property rights of the non-profit company Istorima are not affected in any way. It is also a pre-condition in all cases of commercial use that explicit written permission is obtained containing explicit reference to each direct, indirect, whole, partial, or fragmentary use of the contents of the Archive. Both personal and commercial use carries with it the obligation for responsible and proper use of the contents of the Archive belonging to the non-profit company Istorima in a way that represents the contents truly and in good faith without distorting it, especially where such use involves the transcripts, recordings or videotaped interviews which it includes.

Furthermore, during commercial use it is forbidden to store, reproduce, republish, broadcast, or distribute (e.g., through mass media, social networks, print media, etc.) any part or section of the contents of Istorima’s Archive without the explicit written permission of the non-profit company Istorima, which reserves the right to impose special conditions on a case-by-case basis or forbid the use completely. In these cases, it is a pre-condition that there is clear reference to the company, as well as the obligation for responsible and proper use of the contents as detailed in the above paragraph.

Disclaimer and limitation of liability

The non-profit company Istorima has made every possible effort to ensure that the content of the Archive in its totality is accessible and available to on-line visitors/users.

The non-profit company Istorima does not guarantee and is, therefore, not responsible, even due to mild negligence, for any damage that may be caused to on-line visitors/users by their use of the Archive. Correspondingly, it is not liable for the repair of any damage or to pay financial compensation to on-line visitors/users in relation to its operation or failure to operate, for the smooth running of the internet, the website, the server, or for whether it is free from viruses or other similar elements.

No part of the content of the Archive should be interpreted as encouragement, instruction, or advice to online visitors/users regarding any act or omission, which are totally within the scope of their own volition. The nonprofit organization Istorima records and presents stories in the Archive without adopting the individual attitudes, opinions, or ideas expressed by the narrators or third parties. The nonprofit organization Istorima and the Stavros Niarchos Foundation (SNF), the project’s founding donor, do not necessarily endorse or identify with the content of the narratives presented. Moreover, the nonprofit organization Istorima also provides special warning indications for the protection of minors from possible abusive expressions or the use of bad language. The nonprofit Istorima and SNF as founding donor of the project accept no liability for the use of expressions that may be considered insulting by users of the archive, which may reflect a historical or social reality but do not reflect the organizations’ values.
